1. Introduction

These Terms and Conditions of Sale (“Terms”) govern the provision of estate planning services by Viva Facilities Management Limited (“we”, “our”, “us”) to you, the client (“you”, “your”). By engaging our services, you agree to be bound by these Terms.

2. Services Provided

We provide tailored estate planning services, including but not limited to:

Wills and estate planning documents
Lasting Powers of Attorney (LPAs)
Trusts, including the Viva Capital Protection Trust
Probate planning and support

Your documents are drafted according to your wishes, and decisions regarding their content are entirely your responsibility.

Where applicable, the Viva Capital Protection Trust will be produced by Northwood Banks & Co. Ltd, including any registration with His Majesty’s Land Registry (HMLR).

3. GDPR & Data Protection

In line with the General Data Protection Regulation (GDPR), you confirm that you were happy to be contacted by a third-party company regarding estate planning. All information you provide will be used solely for preparing your legal documents and will be handled securely.

4. Payments

An initial deposit is required before work commences.
A balance payment is due once your Client Summary sheet has been issued and approved.
All prices are subject to VAT at 20%.
By signing your contract, you confirm that the cost of our services is affordable to you and will not cause financial difficulty.

5. Cancellations & Fast-Track Contracts

Standard contracts include a 14-day cancellation period.
If you have chosen an Expedite/Fast-Track Contract, you waive your right to cancel, and work begins immediately. This option is non-cancellable.

6. Client Responsibilities

To ensure timely delivery of your estate planning documents, you agree to:

Provide accurate information and identification documents when requested.
Review and approve your Client Summary sheet.
Pay any outstanding balances in full once your documents are complete.

Clients typically use our services for:

Reducing probate costs and delays

9. Liability

Our services are limited to estate planning as outlined in your contract. We accept no liability for losses arising from delays caused by your failure to provide necessary documents or identification.
